Case Study — Long-Running Representation

Reconciling a 30-Year Service History Across Three Employers

The Challenge

A retiree had worked for three employers over thirty years, with periods of both EPF contributions and civil service pension coverage. The scheme administrator's calculation did not match his own records, but he had not been able to identify the specific discrepancy.

What We Did

We reconstructed the contribution history from payslips, employment records and scheme statements obtained through formal requests. We identified two periods where contributions had not been correctly allocated and prepared written submissions setting out the basis for correction.

The Outcome

One discrepancy was resolved through correspondence after about seven months. The second required a hearing and was resolved twelve months after instructions were received. The client attended neither sitting and was kept informed by written update throughout.

Case Study — Written Opinion

Understanding a Dependant's Entitlement After a Spouse's Death

The Challenge

A widow had received a lump sum payment following her husband's death but believed she may have been entitled to an ongoing pension payment rather than — or in addition to — the lump sum. She had received conflicting information from two different sources.

What We Did

We reviewed the scheme rules applicable at the time of the husband's retirement, his service record and the payment notice she had received. We prepared a written opinion setting out the basis of the lump sum payment and whether an ongoing benefit had also been available.

The Outcome

The opinion confirmed that the lump sum payment was the correct entitlement under the scheme as constituted at the time, and set out why the alternative interpretation was not supported by the rules. The client was able to close this matter with a clear understanding of the position.

Case Study — First Meeting Leading to Written Opinion

Finding the Right Path After an Internal Complaint Was Rejected

The Challenge

A client had made a formal complaint to his scheme's internal complaints process and received a rejection letter that offered no detailed reasons. He was not sure whether to accept the decision or challenge it, and if the latter, how.

What We Did

After a first meeting, the client instructed us to prepare a written opinion. We reviewed the complaint, the scheme rules and the rejection letter, and prepared an opinion that set out three possible routes forward with the likely time, cost and prospects associated with each.

The Outcome

On reading the opinion, the client chose to pursue the most direct route — a formal submission to the relevant authority. He instructed us to handle that, and the matter was resolved through correspondence without the need for a hearing, approximately eight months after the written opinion was delivered.
